The protection of your personal data is of high importance to us, therefore we take all reasonable care to ensure that your personal data is processed safely. This Privacy Statement explains how we collect, use and share your personal information when you visit our Websites and Social Media Accounts.

MM will use your personal information in line with applicable legal requirements. We encourage all users to read this Privacy Statement carefully to learn more about the policies and practices that we have developed to safeguard personal information, and to better understand our relationships with the third parties who may have access to this information.

Personal information we collect

Information you provide directly. We collect and store personal information that you directly provide us through our Websites or Social Media Accounts.

Information collected automatically through our Website

As further described in the “Our Use of Cookies and Other Technologies” section below, we and our third-party partners automatically collect certain types of usage information when you use our Website. For example, when you visit our Website, your device’s operating system, device identifier and other device information, user agent string, Internet Protocol (IP) address, access times, browser type, and log data detailing your interactions with our Website (e.g., number of clicks, pages viewed, information searched for), and the website you visited before and after coming to our Website (i.e., referrer header) are logged automatically.

Information collected through our social media accounts

We receive information about you when you engage with us through various third-party platforms, for example, liking us on Facebook, connecting on LinkedIn, GitHub, Atlassian, following us on Twitter or Instagram, registering for training, webinars or sharing content from our Website on Twitter, or LinkedIn. The data we exchange with these third-party platforms may depend upon your privacy settings with these platforms. You should review and consider adjusting your privacy settings on third-party websites and services before engaging. Do not provide us with any sensitive personal data through these platforms. We are not responsible for the data protection and use practices of these third-party platforms. Please see their privacy statements to learn how they use your information.

Use of cookies and similar technologies

Our Websites and related online services use cookies and similar technologies to enable certain functionality and facilitate navigation as well as to help collect information about your visit. Note however that we do not use cookies to identify you or to track you individually. “Cookies” are small text files, typically containing a unique string of letters and numbers, stored on your hard drive by a Website.

When you return to the Website using the same browser, the Website can read the cookie and thereby gather information about your usage over time. Among other things, we use cookies and other technology to see which areas and features are popular and to count visits, which helps us to improve our Website, our Products, and your experience.

Web beacons

The way we store information

We hold your personal information on data servers that are operated and maintained by third parties under contract with MM. We want your personal information to remain as secure as reasonably possible. To help ensure the integrity and confidentiality of the personal information you provide to us, we may use encryption practices, as required. As an added security precaution, all personal information is kept physically behind firewalls and other network security devices to prevent intruders from gaining access. MM processes your personal information for the period necessary to fulfill the purposes outlined in this Privacy Statement and preserves your personal information in accordance with the provisions of relevant laws and regulations.

The criteria followed are determined by:

  • The purpose of the personal information collected and the fulfillment of that purpose.

  • The ground on which the personal information are being collected: e.g., in case of consent, you can revoke it at any time.

  • Mandatory retention periods provided by contractual and regulatory requirements.

In general, we collect and process personal information about you with your consent or in accordance with our legitimate interests as described in this Privacy Statement and in our notices to you.

For example, we may use your information to:

  • Understand you and your preferences to enhance your experience and enjoyment using our Websites, to provide recommendations, and to better market and advertise to you.

  • Deal with your applications and supporting your use of the website and web-based apps and services.

We may share your personal information with your consent.

  • Among our affiliates, which can include companies owned by or under common ownership of MM, all of which will be required to use your personal information as described in this Privacy Statement.

  • With our partners and other third parties, such as our sponsors and co-sponsors of events or our marketing automation platforms operators, which are contractually bound with us to comply with this Privacy Statement.

  • With other parties in connection with a company transaction, such as a merger, sale of company assets or shares, reorganization, financing, change of control or acquisition of all or a portion of our business or assets by another company or third party, or in the event of a bankruptcy, dissolution, or related or similar proceedings.

  • As required by law or a court decision or if we reasonably believe that such action is necessary to comply with the law or the reasonable requests of law enforcement, to protect the security or integrity of our Websites, and/or to exercise or protect the rights, property, or personal safety of MM, our customers, users, or others. We may also share aggregated or anonymous data with third parties (subject to applicable laws).

International data transfers

MM currently does not support international data transfers.

Your choices about your data

How can you access, correct or delete the personal information about you that we process? You have a right to request to access, correct/update or delete your personal information. You may make such a request at any time, by contacting our Legal Department legal privacy@motivemetrics.com or postal mail at 77 Sleeper Street, 2nd floor, Boston, MA 02210.

We will provide you with access to the information we hold about you, correct/update, and or delete that information that was provided to us by third parties. It is not technologically possible to remove from our servers each and every record of your information. The need to back-up our systems to protect information from inadvertent loss means that a copy of information about you may exist in a non-erasable form that will be difficult or impossible for us to locate. Nevertheless, when permitted by law, MM will delete your personal information stored in the databases MM actively uses for research and daily business activities or stored in other readily searchable media.

In addition, we will use reasonable efforts not to disclose any personal information stored in a non-erasable format after receiving your request for removal, except as required by law.

How can you control your communications preferences?

You can stop receiving promotional emails from us by clicking on the “unsubscribe link” provided in such emails or by contacting us at the contact details set forth below. We make every effort to promptly process all unsubscribe requests. If you opt-out, we may still send you transactional communications (e.g., non-promotional emails such as emails about training and events you registered to attend).

How can you exercise the right to data portability?

According to the right to data portability, you have the right to request that your personal information provided to MM be delivered to you in a structured, commonly used and machine-readable format, subject to certain conditions and can be requested by contacting our Legal Department at privacy@motivemetrics.com.

How can you make a Privacy Complaint with a Supervisory Authority?

If you feel MM’s processing your personal information violates any applicable law, rule or regulation, you have the right to lodge a complaint with your local supervisory authority.
